Personal autonomy as a factor in the decline of the regulatory capacity of law: the crisis of institutions under political-legal liberalism

Abstract

The article aims to identify the social, value-based, and worldview foundations of the decline in the regulatory capacity of contemporary Russian law amidst the crisis of social institutions. The paper views law as a social regulator and analyzes the limits of its impact on individual behavior under changing perceptions of the human being, freedom, and society. Special attention is paid to the role of the state in transforming the status of the individual at various stages of the development of Russian law. The scientific novelty of the study lies in defining personal autonomy not only as an achievement of the modern legal order, but also as a factor capable of limiting the efficacy of legal regulation aimed at solving collectively significant social problems. The research demonstrates that the decline in the regulatory capacity of law is linked to the strengthening of individualistic attitudes and, consequently, the hampering of legal influence on behavior in spheres associated with collective problems. One of the possible solutions to this problem is to rethink personal autonomy from a relational perspective, which allows for combining the protection of individual freedom with the social embeddedness of the subject.
